NOTICE OF HEARING ON PRELIMINARY ASSESSMENT
NOTICE IS HEREBY GIVEN that the City Council of the City of Owatonna, MN, will hold a hearing at a regular City Council meeting to be held at 7:00 p.m. on Tuesday, June 5, 2012, in the Council Chambers of the City Administration Building, to pass upon the preliminary assessment against benefited properties for the construction of 2012 Sidewalk, Curb & Gutter and Driveway Repairs and appurtenant improvements along the following streets:
- S. Grove Avenue 6. E. Vine Street
- S. Elm Avenue 7. N. Cedar Avenue
- S. Cedar Avenue 8. N. Elm Avenue
- E. Mill Street 9. E. Front Street
- Plainview Street 10. 16th Street NE
The preliminary assessment is on file for public inspection at the office of the City Clerk. Written or oral objections will be considered at the hearing.
If you have a question or believe that the measurements or calculation is in error, we would appreciate it if you would call the City Engineer's Office or the City Clerk's Office to discuss the preliminary assessment before the hearing.
An owner may appeal an assessment to District Court pursuant to Minnesota Statutes, Section 429.081, by serving notice of the appeal upon the Mayor or Clerk of the City within 30 days after the adoption of the assessment and filing such notice with the District Court within ten days after service upon the Mayor or Clerk.
No such appeal as to the amount of an assessment to a specific parcel of land may be made unless the owner has either filed a signed, written objection to that preliminary assessment with the City Clerk prior to the hearing or has presented the written objection to the presiding officer at the hearing.
The total estimated cost of the improvement is $38,000.00.
The City Council has provided that anyone 65 years of age, or older, owning and occupying a homestead or who is retired by virtue of permanent and total disability, may ask for and receive deferment of a special assessment against that homestead if that person's yearly income does not exceed the current “Very Low (50%) Income Limits” as provided in the area median income limits published annually by the United States Department of Housing and Urban Development. Forms for requesting this deferment are available at the office of the City Clerk.
